The Latest on the Sergeant's Test Grievance

Since the last update we posted here we've had a few hearings on this matter but no decisions have been handed down yet. The Town unfortunately hasn't budged on their stance which can be summed up as "we didn't do anything wrong, but we're not going to prove it to you. Please stop asking."

On September 26th we had a hearing at Town Hall regarding the Municipal Prohibited Practice (MPP) complaint we filed regarding the Town's refusal to honor our MERA request for the documents from the test that should be able to easily prove or disprove any claims of wrongdoing. Attorney McEleney presented our case to the State Mediator, I'll try to summarize as best as I can though there are a lot of complex legal issues involved that I'll admit I don't fully understand so I won't get into in great detail.

Our case centers on a provision of the Municipal Employee Relations Act (MERA) which states a Union is entitled to any documents from the municipality that it needs to file and argue a grievance. I filed a MERA request with the initial grievance asking for the scores, scoring criteria, and notes of the evaluators so that we could see the reasoning behind the scores and determine if there was in fact any foul play or tampering. Had we been given these documents and they showed the scores were legitimate, we would've been able to drop the grievance and let the promotional process proceed. In response the Town provided us with the raw numeric scores of the candidates, but refused to show us any of the criteria or notes that would explain why the scores are what they are. The purpose of our complaint is to try and force the Town to provide us with these documents so we can make our case.

The Town's counter argument revolves around a provision of the state Freedom of Information Act (FOI) which includes an exception that states test questions and other proprietary information do not have to be disclosed due to an FOI request. Our response to this point is that we're not requesting the documents under the FOI statute, we're asking for them under MERA which has no such exceptions, therefore the language of the FOI statute is irrelevant to our request. The Town seems to be trying to make the argument that an exception that exists under FOI should also apply under MERA, or trump MERA altogether, though they concede there is no prior case law to support this assertion.

Mediation on the issue was attempted and was unsuccessful so the hearing was brought to a close after both sides were done arguing our points. As of this writing we still have not received a decision or response on the outcome of this hearing.

On October 15th we had our first hearing at the Labor Board in Wethersfield. This was supposed to the beginning of the hearing for the actual grievance but the Town requested to change it to a hearing on the arbitrability of the grievance. What this means is the Town is trying to argue that the matter at hand is not subject to collective bargaining or arbitration and therefore the case should not even be heard. There was a lot of legal speak that went over my head and cases cited as to why they believe this that I won't get into because I'd probably get it wrong.

However they also made the argument that the Personnel Appeals Board was the proper avenue to take an issue with a promotional exam and not the Labor Board. I find this assertion comical for a few reasons, first and foremost is that the Town has also refused to show the individuals who filed Personnel appeals their test results, so they're being sent into these appeals with no idea of what they're appealing because the documents are all being hidden by HR Director Santiago Malave. For comparison, imagine going into a court case to fight charges against you and not being allowed discovery, so you have no idea what the evidence against you is until it's presented in the court room. This is what our Town considers a "fair process."

Secondly the Personnel Board is ultimately a part of the Town Government, does it really seem fair that your only avenue to take up an issue you have against the Town, is with the Town!? As Police Officers we constantly hear how there's a need for outside scrutiny of us because an internal investigation can't be impartial. That's the reason why when we have an Officer involved critical incident that results in a death we have to call in an outside agency to investigate it, to ensure impartiality and credibility. So why does the Town think the rest of the Town Government should be exempt from this kind of scrutiny? Now we're fortunate here in East Hartford that our Personnel Appeals Board has ruled against the Town in the past and have shown they can be impartial and I'm grateful to have them as an option, but I don't think it should be your only option.

Attorney McEleney put on a great case on our behalf and was able to show that our labor contract does include provisions that govern how promotional tests will be handled so the issue is clearly arbitrable. He was also able to argue that while the Personnel Board is another venue to deal this matter, it's not the only one. Briefs on this matter were submitted last week and now we wait for a decision, if the case is determined not arbitrable then the grievance will be dismissed, otherwise we'll schedule a new hearing date to begin presenting the actual case before the Board. Though we may have to wait until the MPP matter is settled first as we'd like to have the documents we requested to help us make our case.

On September 24th the members who filed Personnel Board appeals had their first appearance, though it was more of a formality for the Board to officially accept their appeals and set hearing dates. Attorney McEleney is representing the members in their appeals.

On November 18th at 1700 hours at Town Hall there will be another Personnel Board hearing where Attorney McEleney will argue for the Board to authorize the release of the evaluator's notes and scoring criteria so our members will at least have a fighting chance in their appeals. I know everyone has busy schedules, but if you can make some time in yours it would be great to have as many members come down to the hearing as possible to show your support. I get asked about this issue daily by members who are outraged over what's been going on, if you're pissed off, please come on down and show it. One of the reasons the Union got involved in this matter is because it wasn't just the handful of people who took the test who were upset about what happened, but because the entire Department found it reprehensible, let's show them this issue affects everyone.

Once we have some more hearings or get any decisions I'll update here again.

Look to me like the day to pay is coming for the union and they are scared to death of it. All they do is bully and harass those who don’t fit in their good old boys club and they might be shocked at this public meeting when other members come forward to let the world know of their unfair treatment of others that stand up to them, a recall meeting should follow or refuse to pay them dues for treating other members this way. All should be treated fair no matter there sex or skin color.

I just heard there is yet another issue regarding her not being truthful about her qualifications and a Hartford detective told our administrators that he did not want to work with her because she has no credibility. What will they do about that? The same thing they have done which is absolutely nothing! People are sick of Hanlon will walking around saying “Let’s not upset her” like he always does because he is either afraid of her or counting the days until he finally gets out. 👋The IA division has made a mockery of this place and she is just the product of their incompetence.

I’ve been watching from a distance. I don’t really want to be involved. But I have to say that if you read her complaint, she’s basically saying that this entire department hates women. I know we don’t and have never felt that way. I don’t see how that is possible? We had two women lieutenants! Three at one point years ago. We had one of the first female supervisors in the State. There are no current female supervisors because no current female officer has taken the test. We have a female officer in admin, we have them in swat, peer support, we have female detectives, a female in a task force, and female SROs. Tara is set to be a supervisor soon and will be great.

Who is K. Nieves? Is he the ex-Norwich cop that Decimate try to get put in prison but the jury didn’t find her credible at all? It’s amazing her credibility issues persist to this day. Courtney Decimate is a bad person with zero honor and zero integrity. She should be fired immediately and not allowed to ever be a cop again. The biggest mistake the EHPD ever made was hiring her from an agency that no longer wanted her. The problem with her is not that she is a woman, it’s that she is a complete sociopath that would turn a benign conversation into an attack to achieve her ends. Never trust her, and never be in a one to one conversation with her. Spell check changed Desilet to decimate. It’s seems like a logical correction so it was kept.

Why hasn't our admin done anything about this situation? Can't Sansom go to Town Hall and demand to see the test notes? Unless he already knows because he's involved. Speaking of which, where are Sansom and Hawkins right now? Their house is burning down and theyre on a all expenses paid trip to a conference in Chicago where I'm sure they're jerking off a bunch of other useless chiefs and telling war stories that never happened. Kenny Rosa was a terrible cop and a coward. He hired people that didn’t intimidate him because he had one friend here that he turned on and tried to have him arrested and fired. His true colors came out when he had a chance to be a leader as chief and quit within a record 38 minutes on the job. I usually don’t get involved in the politics and bs that goes on here but I have to admit that I am disappointed with the way things have turned out with his leadership. I agree and feel that this department has suffered a major setback as far as leadership and the double standards they allow. This administration expects the utmost professionalism out of the officers however themselves have let the place go off the rails by not making decisions in a timely fashion and pass the buck to the supervisors to handle the daily issues and then sell them out at the drop of a hat. It’s great that the community loves us but what matters is the support from the chief. That support comes from paying attention to the departments needs and officers first rather than pandering to the public with the bbqs and ice cream floats and singing kumbaya with the locals. He can post all the “Serving the community with pride and integrity” all he wants BUT he failed to see that HE and his administration need to serve this department AND his officers with the same. They have lost me and I feel have only contributed to this mess by being absentee administrators.

I'm still waiting for the memo that says lying to supervisors and crying numerous times in the building is frowned upon. Crushed hats and metal badges were the initial plan. But it doesn't overshadow the real issues. We are a good PD. We shouldn't allow negligent hiring and retention to discredit the professionalism and dedication of the majority. Threaten the misfits. Not the masses!!

To be honest, he’s a real personable guy when I run into him on the pavers. He does seem to be over his head as all he talks about is his career in Hartford. I’m not new but not an older guy either but have to control myself from laughing when I see him once and awhile and he tells me the same story about how he arrested some criminal or did something that I have already done a dozen times. He does seem more sincere than the others especially deputy hawkins who always tells me what I want to hear and comes across as phony to me. I don’t trust him and others have told me to be careful around him as he tells others what is said. This is just how I feel about them although I do think it could be worse elsewhere.

One of the biggest mistakes was what he did with Sarah. Bottomline is no matter how he tried to cover it up and play it off it just didn’t look good to the troops. Even if she was so intelligent like he says, she used him and the department to pay off her loans. He allowed that and didn’t care what it looked like. On top of that, when is yoga pants, thigh high boots and nose rings deemed professional dress code unless your thinking with the wrong head maybe? So sad to see Bonnie leave broken and in tears because of his infatuation with Sarah.

This is a self correcting problem...if you simply correct the one person who is at the eye of the storm. And what operations are being impacted? The ridiculous attempt at tricking the locals that the PD is running smoothly with the PR events? Or is it the sudden mandatory training on fire extinguishers and oil spills? Talk about insulting people with step by step instructions on common sense matters. These memos would be unnecessary if the problem child was told NO. Get a grip on reality. Maybe CALEA needs to make a policy on how to become an effective leader. Step number 1:don’t surround yourself with ass kissers and guys that did no real police work and or hid behind garbage cans when there were shots fired. Step2: Hire administrators with more than a ged from Jiffy Lube or Buckley High school in home economics. Step 3: take constructive criticism from your management and don’t yell and scream at them like a madman as it makes you look like douche bag and makes them hate your guts and bash you to everyone. This place sucks. I’m embarrassed to work here. I would quit but I need it for my family. We are a barely functioning police department. The chief has potential and is personable but he is not in control. One officer runs this department right now. She is in charge and has taken the power. Not because she did anything to earn it, rather she did everything to shit on this agency. Courtney is malicious and evil. Do you think that memo is going to do anything but make us angry? We’re angry at the double standard. You are allowing ONE officer to strip this place of normalcy.
She gets run off every squad. First she wanted K9. “I’ve always wanted to be a k9 officer”. Then she failed. Then she wanted VINS because she was the best at saying “change this to a weapons violation” for finding a box cutter on a warehouse employee. Then she constantly disobeyed supervisors by doing her own thing when she was on patrol. Camp, Spragg, and Fic saw the writing on the wall and wrote her up for her bullshit. But you swept that under the rug. Then she got VINS and had to be hand fed every case by Nestor. Then they fell in love and he got her access to Hawk. Then hawk got access to weaver. Then Courtney is untouchable. So what does she do? She googled sex trafficking and passed off other people’s research as her own. Openly lies about her abilities on LinkedIn and you allow it. Not only do you allow it, but you give her the freedom to just create a position? What is her assignment? When does she work? What was her last case? Is she in training or vins? Why are Your staff wants answers and you play ignore us or say it’s beyond your control. I guarantee you that if anyone commenting on this thread pulled any of her bullshit you would shut us down. You want a well oiled machine here...sometimes you have to look in an engine and find the part that isn’t working and replace it. You have a great group of dedicated officers. You could have the department you want, and you could be the leader we want but you’re not. Moral here hasn’t been this low since I’ve been here. What do I know though? I’m not one if your “untouchable” supervisors. But I promise you this, if y ou reward her behavior with a promotion then this department will fail publicly. She is not safe, she is not stable, and mark my words...she will get someone here hurt or killed in her endless attempt to impress people. When that happens this blog will make extremely compelling evidence in any lawsuit.

Things weren't always this way. This used to be a really great place to work, and it's still pretty good compared to some other PD's. This admin seems to have brought all the corruption from Hartford across the river with them. We used to laugh at all the craziness going on in Hartford and now it's here thanks to a self serving chief and his best deputy jiffy lube mack.

If you think I’m lying than why did he bring over that weasel from Manchester that arrested his own cops than would brag about it when he got hammered at the hungry tiger. Speaking of CALEA, I imagine one of their core values is Honesty and Integrity. Lets live up to our accreditation...the person who assisted in the process is ironically the center of problematic focus. Being a brown noser and helping with the Calea process should not give immunity to the very rules being laid out by the program. This is where the Pride and Integrity come alive from the stencils on the walls at Headquarters. She only wanted to help her own resume' and brag about it in her LinkedIn profile. No genuine desire to help the rest of us succeed professionally. This place could be so good if we drained the swamp and stopped with the special flavors. Thanks a million Rosa. Word is they have Dave Brown and that weirdo Muthe guy working to shut the blog down. You can’t limit freedom of speech and let them try! Bring them to federal court and sue the crap out of them! By representing Twohig he disrespected all of the officers who really have seen some horrific things in their career. That kid should have never been hired to begin with but the chief knew it. He put all of the other officers at risk by hiring a kid that he openly admitted to skipping for that kid as a favor for his Hartford buddies.

Not because she’s a female but the way she has crapped all over every squad she worked, was defiant bosses that told her NO, and refused to share anything with anyone as to make herself look like something she clearly not aka her bio LinkedIn page. The way he treated Juergens was uncalled for. Yeah he had a horrendous haircut but he didn’t deserve to be strung along by sansom than kicked to the curb. The guy gave a shit about people and had the knowledge of the agency for 30 years. What did we get instead? A guy that abuses the miles on his company car to the point he has to use lieutenants cars on the weekend to keep the mileage from sending up a 🚩.

I feel bad for the good millennials in the agency. It's tough when someone like her represents the selfishness, lack of respect for rank or seniority, and the constant implication of unfairness known to millenials. Most of the younger cops are doing great but she gives a bad image to the generation. The recent antics are just a sneak peak of her performance as a supervisor. Oddly enough, she hates taking orders from anyone but feels she is ready to dish them out. Let's hope none of the new folks think she is going about this career correctly. Remember, we are here to fight with criminals. Not each other.

I just finished up my fto over here at HPD and I’m feeling real good. I just found out I’m being promoted to detective in major crimes. I’m as shocked as you guys are, apparently I had a perfect score on my oral board. (Thanks Chief) Over here things are just as beeped up as they are in east Hartford but even our guys don’t believe she got a 100 on the oral. That’s awesome man, I am glad to hear it. Things definitely get better once you get the heck out of ehpd. The place is just a cesspool of negativity and back stabbing. I myself have followed my passion and deliver furniture and volunteer at the humane society. The money isn’t nearly as good but I don’t have to be around all those terrible people.
